8 Steps to Selling a Firearm in Texas

As a rule, you do NOT need to obtain a state license to sell firearms. There are no such laws or regulations in Texas. 

However, Federal Law 18 USC § 922 (g) prescribes several prohibitions according to which a person cannot purchase a weapon:

  • Convicted for more than a year by a court decision for a crime
  • Fugitive from justice
  • An illegal user of prohibited substances
  • Mentally ill person 
  • Illegal alien
  • Dismissed from the US Armed Forces in dishonorable conditions
  • Renounced US citizenship
  • Convicted of a domestic violence offense

If you belong to at least one group from the above list, you will not be able to buy a firearm and create a Texas Firearm Bill of Sale Form with the seller. For this reason, view all the laws and regulations of concealed carry in Texas in advance. The Criminal Code (Chapters 10 and 46) and the Government Code (Chapter 411 and § 46.035) will help you with this.

1. Review all Relevant Laws

2. Clean Your Firearm

4. Discuss the Details of the Transaction 

Before drawing up the firearm bill of sale, discuss all the details with the buyer. It will allow you to avoid misunderstandings and possible conflicts in the future. Make sure that the buyer is not a fraudster by checking the identity proving document if possible.

5. Fill out the Firearm Bill of Sale Form

The buyer must meet the requirements of Texas for the storage of guns. Next, both parties must provide the following information:

  • The signatures of two parties

6. Notarize the Document
